Pythons link to mammals decline

Burmese pythons, originally kept as pets, are the likely cause of a severe mammal decline in Florida's Everglades.

A team studied road surveys of mammals in the Everglades National Park before and after pythons became common.

Researchers found a strong link between the spread of pythons and drops in recorded sightings of racoons, rabbits, bobcats and other species.

In PNAS journal, they report that observations of several mammal species have declined by 90% or more.

The national park covers the southern 25% of the original Everglades - a region of subtropical wetlands that has been drained over the last century to reclaim it for human use.

As Burmese pythons have made it from captivity into the wild, the absence of natural predators has allowed populations to balloon. Intermittent sightings were recorded for 20 years before the snakes were recognised as being established across the Everglades in 2000.

The pythons are now established across thousands of sq km in southern Florida. Although there are no accurate figures for how many there are, the numbers removed from the Everglades reached nearly 400 in 2009 and has been increasing year-on-year (apart from a slight drop in 2010 due to a cold spell).

"Any snake population - you are only seeing a small fraction of the numbers that are actually out there," said said Michael Dorcas, one of the study's authors, from Davidson College in North Carolina.

He told BBC News: "They are a new top predator in Everglades National Park - one that shouldn't be there,"

"We have documented pythons eating alligators, we have also documented alligators eating pythons. It depends on who is biggest during the encounter."

Earlier this month, US Interior Secretary Ken Salazar announced that the US was poised to approve a ban on importing Burmese pythons. But some observers at the time remarked that the move was about 30 years too late.

Getting ambushed

Prof Dorcas and his colleagues looked at data on mammals found during roadkill surveys from 1993-1999, and on live and dead mammals encountered during nighttime road surveys from 1996-1997.

They then compared these results with similar data collected between 2003 and 2011, after the pythons were recognised as being established.

They found that observations of raccoons and opossums had dropped by about 99%. There had been a 94.1% fall in observations of white-tailed deer and an 87.5% decrease in sightings of bobcats.

No rabbits or foxes were seen during the more recent survey; rabbits were among the most common mammals in the roadkill survey between 1993 and 1999.

The majority of these species have been documented in the diet of pythons found in the Everglades National Park. Indeed, raccoons and oppossums often forage at the water's edge, where they are vulnerable to ambush by pythons.

Observations of rodents, coyotes and Florida panthers had increased slightly, but the overall number of sightings remained low.

The researchers also found that the declines in mammals coincided geographically with the spread of Burmese pythons. Mammal species are more common in areas where pythons have only been recently introduced, and are most abundant outside the snakes' current range.

Prof Dorcas said more research was needed to assess the impact of such large declines. But he added: "It's not unreasonable to assume that any time we have major declines in mammals like this it's going to have overall impacts on the ecosystem. Exactly what those are going to be, we don't know. But it's possible they could be fairly profound."

The ban on importing Burmese pythons has come after five years of debate and lobbying in Washington DC. Florida's Democrat Senator Bill Nelson was among those who campaigned for a ban, unravelling the skin of a 5m-long Everglades python at a 2009 Senate hearing to make his point.

But reptile breeders and collectors had disputed that the tropical snakes posed much risk beyond south Florida and argued that any ban would harm a multi-million dollar industry.

Although the ban is unlikely to have much impact in southern Florida, where the reptiles are already established, scientists say it could help prevent their spread to other suitable habitats in the US, such as southern Louisiana and south Texas.

BTG's varicose-vein drug successful in U.S. study (Reuters)

LONDON (Reuters) ? British pharmaceutical firm BTG said the first of two U.S. trials of its varicose vein treatment Varisolve had met all its end-points, bringing a launch of the long-delayed product a step closer.

Varisolve is a ground-breaking treatment that uses an injectable foam to dissolve the veins as an alternative to stripping.

Its development, however, received a major setback in 2003 when regulators in the United States halted a trial of the drug over concerns about side effects of the foam and its active agent Polidocanol.

BTG's Chief Executive Louise Makin said on Monday that she was "delighted" with the outcome of the first trial.

She said the results of a second study would follow, and the group was on track to submit an application to U.S. regulators by the end of the year.

BTG, which also sells niche anti-poison treatments, decided in 2010 to market Varisolve itself in the United States rather than sharing development costs with a partner.

Shares in BTG, which have risen 15 percent in the last three months, closed at 323.7 pence on Friday, valuing the firm at 1.06 billion pounds ($1.66 billion).

Neeson's "Grey" wins box office weekend (omg!)

LOS ANGELES (Reuters) - Survival story "The Grey" starring Liam Neeson in a battle against weather and wolves led the box office pack with a better-than-expected $20 million in ticket sales over the weekend.

"The Grey" knocked last weekend's winner, "Underworld: Awakening," to second place. The vampire and werewolf sequel starring Kate Beckinsale brought in $12.5 million from Friday through Sunday at domestic theaters, according to studio estimates compiled by Reuters on Sunday.

In "The Grey," Neeson returns to an action role as a man who leads a team of plane crash survivors who must fight harsh weather and a fierce pack of wolves in the Alaskan wilderness.

The movie played at 3,185 North American (U.S. and Canadian) theaters and earned a per-theater average of $6,279, according to the box office division of Hollywood.com.

Distributor Open Road Films acquired the film for about $5 million and had projected up to $12 million in debut weekend sales. The film beat that forecast because "it doesn't look like every other movie out there. In a crowded marketplace, I think it's important to be distinctive," said Open Road Films CEO Tom Ortenburg.

Katherine Heigl's new comedy, "One for the Money," finished in third place with $11.8 million, topping industry forecasts of less than $10 million for the film based on a best-selling book by Janet Evanovich. Distributor Lions Gate Entertainment said readers who loved the book helped the movie beat expectations.

"We think the audience that showed up are not frequent moviegoers. They're just huge fans of Janet Evanovich," said David Spitz, head of domestic distribution for Lions Gate.

In the film, Heigl plays a cash-strapped woman who joins a bail-bond business and must track down a wanted man who happens to be an ex-boyfriend. Audiences surveyed by exit polling firm CinemaScore game the movie a B-minus on average.

OSCAR BOOST

The weekend's other new movie, crime drama "Man on a Ledge," landed in fifth place. The film was distributed by Lions Gate's newly acquired Summit Entertainment unit as release dates and marketing plans were set well before the studios combined earlier this month.

"Man on a Ledge" took in $8.3 million, within studio forecasts. The movie features "Avatar" star Sam Worthington as a fugitive who threatens to jump from a hotel ledge.

"Red Tails," a drama about black fighter pilots in World War Two, brought in $10.4 million to land in fourth place in its second weekend in theaters.

Also this weekend, a crop of films capitalized off last week's Oscar nominations.

"The Descendants," starring George Clooney as a father dealing with a family crisis, expanded to 2,001 theaters from 560 and gained 176 percent from last weekend. The movie took in $6.6 million, lifting its domestic tally to $58.5 million since its release last November. The movie has added $27 million in international markets for a worldwide total of $85.5 million.

Black-and-white silent film "The Artist" increased its weekend sales by 40 percent from a week earlier, bringing in $3.3 million after adding 235 more screens. To date, the film has grossed $16.7 million domestically.

Family film "Hugo," which led the Oscar nominations with 11, also jumped 143 percent to $2.3 million. Its total sales to date stand at $58.7 million domestically.

Open Road Films, a joint venture between theater owners Regal Entertainment Group and AMC Entertainment Inc, released "The Grey." The film unit of Sony Corp distributed "Underworld: Awakening." "Red Tails" and "The Descendants" were released by divisions of News Corp's Fox Filmed Entertainment. Privately-held The Weinstein Co released "The Artist," and Viacom Inc unit Paramount Pictures distributed "Hugo."

Dates set for elections to replace Giffords (AP)

PHOENIX ? Arizona Gov. Jan Brewer has picked dates in April and June for the special elections to choose a replacement for Democratic Rep. Gabrielle Giffords.

Brewer on Friday set the primary election for Tuesday, April 17. The general election will be held on Tuesday, June 12.

Several Democrats are considering running for the seat representing District 8, which includes parts of Tucson and Santa Cruz County and all of Cochise County.

One Republican is formally in the race, and two others have assembled exploratory committees.

Giffords resigned Wednesday, a little over a year after she was severely wounded while meeting with constituents at a Tucson supermarket. Six people were killed and 12 others wounded.

She said she needed more time to recover from the traumatic brain injury she suffered.

Vlingo responds to privacy issues raised about its Android app

The popular Android app Vlingo has come under a bit of fire the past several days, as it seems the application is sending a bit more data than they explain in their privacy agreement.  The folks over at Android Pit found some things that raised a few eyebrows, so we reached out to Vlingo to see what was what, and if we need to worry.  We spent some time talking to product engineers, and our conclusion is that everything's on the up-and-up, but there were some issues with the way their privacy agreement was written or presented to the user and a software bug or two at work.  

Things get a little muddy, partially because there's more than one Android version.  One is available in the Market for any device to download, and there's a more customized version offered by OEM's like Samsung on the Galaxy Note.  Different versions with different licenses and agreements simply led to the wrong version of the privacy agreement being presented to the user.  The developers and staff at Vlingo recognize that there's an issue, and were completely transparent about the entire thing.

They also came across a bug that allowed the service to run even if the user initially canceled the request, and another that sends location data when none is requested.  Again, Vlingo was up front about the issue and answered any questions we asked.  They even have set up an opt-out process for folks who don't want to use the product with these issues, and they will delete all user data from anyone who requests it.

Yes, it's bad when software bugs force an application to send the wrong data.  It's also bad when users aren't presented with the correct use policies -- even though most would never read them.  But these types of things happen, and the real test is how the company reacts when presented with issues of this sort.  And Vlingo aced it.  They were courteous, and seemed genuinely concerned about the issues, without trying to back pedal or lay the blame at someone else's feet.  This kind of transparency with the community is exactly what we deserve and expect.  Hit the break for the official statement, in its entirety.

"Working out should have been a part of a new mom's regimen before she got pregnant, while she was pregnant, and for the rest of her life," Jenkins told MTV News. "It should be part of your daily life, just like brushing your teeth or combing your hair. It's your internal hygiene. "The goal should not be to lose weight," she added. "The goal should be to live a healthy life, and by working out and eating healthy, you will be happy and the weight will just fall off because you are making healthy choices." So, where should Beyonc&#233; start in her quest to get her fantastic abs and toned legs back? With her doctor, according to Jenkins. "A new mother should first wait until she gets clearance from her doctor, and she can immediately start by making healthy food choices. Once a mother receives clearance from her doctor, then her starting point depends on her fitness level," Jenkins said. "A weekly workout regimen should include all of the components of fitness &#8212; cardio, flexibility, muscular strength and muscular endurance &#8212; for overall functional health and fitness and for maximum results." Jenkins prescribes a strict training and diet program to her celebrity clients &#8212; a four- or five-day-a-week mix of cardio, endurance exercises like circuit training, and strength and flexibility training, including yoga and Pilates &#8212; but understands that the outcome will be more successful if the new mom is enjoying the regimen and has realistic expectations. "A new mother has to eat healthy for herself and for her child, but she also has to live and have a good time too," Jenkins said. "From my experience, if you make healthy food choices 80 percent of the time and eat whatever you like 20 percent of the time, then you will have great results. I recommend to my clients to eat healthy Monday through Friday and then let go on the weekend and enjoy yourself." </p><div class="player-placeholder right" id="vid:724613.id:1676907" width="240" height="211"></div><p> The trainer also noted that, "When people are having a good time, they are more likely to stick to their program." "The goal is to find activities and workouts that you enjoy so that you keep it a part of your life forever. Consistently mix it up, and enjoy working out," she advised. "Try yoga, Pilates, playing in the park with your kids, hiking and kickboxing." She also recommended dancing, which we know Queen B has down to a science. For those not lucky enough to have a personal trainer or unable to sneak away to the gym, Jenkins said, "A walk with the baby in a stroller is good enough. It will help a mother lose their extra baby weight by boosting metabolic rate and increasing caloric expenditure, but more importantly it will give you a boost of happy hormones so you feel great and it cleans out your internal organs, improving your body's pH balance and decreasing your risk of illness and disease." For Jenkins, the keys to a successful workout program are progression and variety. "Training for peak condition is just like training an athlete for peak performance. It has to be done in a healthy progression to maximize results and decrease risk of injury," she added. "For the best weight-loss and toning results, it is important to train the entire body head to toe through all of the components of fitness with an emphasis on using the core at all times. It doesn't matter if she is power walking, doing yoga or cooking in the kitchen, the core needs to be consistently engaged. Always pull your navel to your spine." Beyonc&#233; reportedly maintained a healthy diet throughout <a href="http://newsroom.mtv.com/2011/12/16/jay-z-supports-beyonce-by-going-on-strict-healthy-diet">her pregnancy</a>, and just days before giving birth at New York's Lenox Hill Hospital was spotted <a href="/news/articles/1676647/beyonce-pregnant-new-years.jhtml">looking "amazing"</a> while dining out with her hubby in Brooklyn, New York. If she keeps up her tireless work ethic, there's reason to believe she'll be back in bootylicious shape in no time.</p>

A leukemia drug kills cancerous T-cells while sparing normal immunity

Leukemic cutaneous T-cell lymphoma (L-CTCL) is a leukemia arising from T-cells, a type of white blood cell. This cancer can involve the skin and other organs, and patients often die within three years.

Rachael A. Clark, MD, PhD, BWH assistant professor of dermatology and associate dermatologist and Thomas Kupper, MD, BWH Department of Dermatology chairman and their colleagues now report a new study that low-dose Campath (alemtuzumab) not only treats patients with L-CTCL but does so without increasing their risk of infections.

The study was electronically published on January 18, 2012 in Science Translational Medicine.

Campath was previously believed to kill all lymphocytes (T-cells and B-cells) in the body and render patients susceptible to infections. However, Clark and Kupper found that Campath only kills T-cells that enter the bloodstream, but it spares a newly discovered population of T-cells that live long-term in the tissues.

"We noticed that our patients were not getting infections, and we looked in the skin. We saw healthy T-cells remaining there despite the fact that there were no T-cells in the blood," said Clark. "We used to believe that most T-cells responsible for protecting against infection were in the bloodstream. But we now realize that highly protective T-cells also inhabit tissues such as the skin, lungs and gastrointestinal tract. It is these tissue resident T-cells that are critical in protecting us from infection on a day-to-day basis."

By showing that Campath kills circulating T-cells, including the cancerous T-cells, but spares tissue resident T-cells, Clark and Kupper have shown that Campath effectively treats L-CTCL while sparing normal immunity. Their findings are also the first demonstration in human beings that tissue resident T-cells provide frontline immune protection of the skin.

"We're very grateful to our patients for entrusting us with their care and for teaching us important lessons about the immune system." said Clark.

In a companion piece, Mark Davis, PhD, Stanford University School of Medicine, called the work a "translational tour de force."

Legal challenge threatens UK&#39;s new nuclear plans | JunkScience.com

Campaign group highlights nuclear industry subsidies it believes are in breach of EU rules

The European Commission could prevent new nuclear plants being built in the UK if it upholds a complaint over alleged unfair subsidies submitted to Brussels by a pro-renewables campaign group.

The Energy Fair group, which comprises high-profile anti-nuclear politicians, lawyers, and environmentalists, argues that the cap on liabilities for nuclear accidents is technically a subsidy, and as such illegal under EU law.

The legal action could ultimately block the UK?s plans to deliver 16GW of new nuclear power over the next 15 years, disrupting plans for new reactors currently being pursued by energy firms such as EDF, RWE and E.ON.
However, the government insisted it does not provide subsidies to the nuclear sector and will contest any legal action designed to block or delay its plans.

Gabriel Aubry could be in major trouble with the law.

The Canadian model, who shares custody of three-year old Nahla with Halle Berry, is under investigation for allegedly screaming at his nanny last week and shoving her out a door... while the woman cradled the child in her arms.

According to a police report published by TMZ, Aubry kept Nahla home from school last Wednesday, unbeknownst to the nanny. When she arrived at Gabriel's house and asked why the tyke was not in class, Berry's ex supposedly went off on her:

"You're the f*cking nanny. Who do you think you are? You are a nobody. You don't need to f*cking know anything."

He then pushed her out the door.

Weaver revisits paranormal with 'Red Lights' (AP)

PARK CITY, Utah ? Sigourney Weaver may not believe in ghosts, but the paranormal world of her latest film is not alien territory for her.

Weaver's Sundance Film Festival premiere, "Red Lights," is a dark exploration of the supernatural realm she previously took on in comic mode with "Ghostbusters" and its sequel.

"I probably don't believe in fairies and ghosts, but I certainly believe that people have souls," Weaver, 62, said in an interview. "I think that, and that's there's more going on around us than we can explain in a rational way."

What did surprise Weaver in preparing for her role is "what a huge business psychic entertainment was," she said.

"Red Lights" features Weaver as a skeptic whose life's work is debunking phony claims of the paranormal. The film from writer-director Rodrigo Cortes co-stars Robert De Niro as a superstar of the psychic realm, Cillian Murphy as Weaver's assistant and Elizabeth Olsen as one of their students.

There has been talk of a third "Ghostbusters" movie that would reunite Weaver with Bill Murray, Dan Aykroyd and other co-stars. Weaver likes the idea but has doubts it will happen.

"I'd love to work with everybody again," Weaver said. "I think, mmm, at this point, I think it's probably less than 50-50. That's what I think."

Another sequel to one of Weaver's blockbusters definitely is on. But Weaver cannot say much about "Avatar 2," James Cameron's next chapter in his science-fiction franchise. The first "Avatar" film was the biggest commercial smash of modern times, making $2.8 billion worldwide.

Weaver's character died and underwent a cosmic transformation in "Avatar." But Weaver has been bumped off before in her "Alien" sci-fi franchise and came back to battle on in another sequel.

"As Jim would say, there's no death in science fiction," Weaver said. "But no, I can't really talk about it. But I am looking forward to it."

Weaver is more talkative about a film that's an offshoot of the franchise that made her a star. In Ridley Scott's 1979 hit "Alien," Weaver played Ellen Ripley, the lone survivor of a spaceship crew terrorized by an unstoppable creature.

She earned a best-actress Academy Award nomination as Ripley in Cameron's 1986 follow-up "Aliens," and she reprised the role in two more sequels.

Scott makes his return to science fiction with this summer's "Prometheus," a cousin to "Alien" that stars Charlize Theron, Noomi Rapace and Michael Fassbender. The director and his actors have been coy about whether "Prometheus" is an outright prequel to "Alien," though they have said there are connections between the films, and the trailer for the new one has images resembling the design and features of the 1979 tale.

"Whatever they call it, I think everyone's very excited to see what Ridley does with some of these wonderful elements, and I think I'll be just as excited as everybody," Weaver said. "I don't really want to know anything about it. I have great confidence in him, and I'm sure they'll make a wonderful movie."

Could Weaver ever imagine resurrecting Ripley for another film?

"No. Let the poor woman rest," Weaver said. "No one ever believed her, anyway. They gave her such a hard time."

Greece names and shames alleged top tax evaders

(AP) ? Debt-crippled Greece has named some 4,000 alleged tax dodgers, including a former media magnate and a prominent entertainer, with the worst offender owing the state nearly euro1 billion ($1.3 billion).

But much of that money might never be reclaimed, as some of the top offenders are in prison or their companies are bankrupt.

The list published by the Finance Ministry late Sunday is part of a campaign to crack down on rampant tax evasion, which ? coupled with inefficient tax collection ? is hampering the recession-hit eurozone member's painful efforts to avoid bankruptcy.

At the top of the list was a 58-year-old accountant, currently serving terms of more than 100 years in prison for tax fraud, who allegedly owes some euro950 million. Most of that sum, however, is in surcharges and fines.

At least another three people convicted over the same scam figure high on the list, which includes debts of more than euro170,000 ($221,000).

But ministry officials acknowledged that it would be extremely hard to collect many of the outstanding debts ? which total nearly euro15 billion ($19.5 billion).

"The truth is that these lists contain debtors who in some cases have owed the money for a long period of time, so after a certain point one does not expect to be able to collect the debts," finance ministry official Haris Theocharis said Monday.

"But I'm sure that there are possibilities ... In some cases (publication) will push debtors to settle their debts, and tax offices to redouble their efforts," Theocharis, who is head of the ministry's general secretariat of information systems that compiled the list, told the Associated Press.

Theocharis argued that the list could also dispel popular misconceptions on the recovery prospects for such debts.

"When more than a year ago the finance minister of the day tried to table legislation to cancel some of these debts that were considered impossible to reclaim, there was a public outcry," he said.

"People say, 'oh there's euro41 billion in outstanding (tax) debts, and if we reclaim that sum then we won't have any problems,'" he said. "This kind of talk has no meaning."

Despite repeated pledges over the past two years, Greek officials have failed to make progress in collecting outstanding debts, which the European Commission task force for Greece calculates at about euro60 billion ($78 billion) ? little more than a tenth of which is seen as collectible.

The country's annual gross domestic product is about euro218 billion, while the 2011 budget deficit is expected to be around euro19.7 billion.

The government has acknowledged the grave shortcomings of its tax service, even admitting that a hugely unpopular new property tax under which nonpaying households will have their electricity cut off might not have been imposed if the tax collection system were more efficient.

An aggressive evening debate capped the bewildering day.

Former Sen. Rick Santorum played aggressor for much of the night, trying to inject himself into what seemed increasingly like a two-way race with little more than a day remaining until the South Carolina polls open on Saturday. He accused Gingrich and Romney of "playing footsies with the left" when it came to health care. Both men rejected the allegations.

The debate began a few hours after first word that Romney had been stripped of his Iowa caucus victory, only to be stung a few hours later by Perry's withdrawal and endorsement of Gingrich.

Gingrich, in turn, was accused by an ex-wife of seeking an open marriage so he could keep his mistress.

"Newt's not perfect, but who among us is," said Perry, abruptly quitting the race just before the first-in-the-South primary.

His decision to end a once-promising candidacy left Romney, Gingrich, Santorum and Texas Rep. Ron Paul the remaining contenders in the race to pick a Republican to challenge Democratic President Barack Obama this fall.

Nine hours after Perry exited one stage, the four remaining contenders walked onto another for a final pre-primary debate.

Gingrich angrily denounced the news media for putting his ex-wife front and center in the final days of the race. "Let me be clear, the story is false," he said. Santorum, Romney and Paul steered well clear of the controversy. "Let's get onto the real issues, that's all I've got to say," said Romney, although he pointed out that he and his wife, Ann, have been married for 42 years.

The audience gave Gingrich a standing ovation when he assailed the media, a reaction he can only hope is reflected in voter sentiment on Saturday.

All four remaining GOP candidates lustily attacked Obama, while Santorum in particular sought to raise his own profile.

Introduced to the audience at the outset, he mentioned his change of fortunes in Iowa, where an evident eight-vote defeat in caucuses on Jan 3 was belated transformed into a 34-vote advantage ? though the Iowa Republican Party did not declare a winner.

Santorum jabbed at both Gingrich and Romney, but seemed to focus more attention on the former. If Gingrich is the party nominee, he said, "you sort of have that worrisome moment that something's going to pop. And we can't afford that in a nominee."

Tape shows cruise ship crew denying emergency (Reuters)

ROME (Reuters) ? A crew member of the capsized Costa Concordia told the Italian coastguard the vessel had only suffered a power outage and there was no emergency onboard, even after passengers had put on life vests, according to a new recording aired on Thursday.

News channel Sky TG 24, which broadcast the tape, said it was the first radio conversation between the coastguard and the cruise ship after the liner, carrying 4,200 passengers and crew, hit a rock off Tuscany's coast on Friday night and keeled over.

The conversation began at 10:12 p.m. (4:12 p.m. ET), about 30 minutes after the accident, Sky TG 24 reported.

By then, many passengers had called relatives on their cell phones asking them to alert the police, who in turn told the coastguard to check on the state of the ship.

"Good evening Costa Concordia, please, do you have problems on board?," a coastguard official asks the bridge.

An unidentified member of the crew replies: "We've had a blackout, we are checking the conditions on board."

The coastguard asks: "What kind of a problem? Is it just something with the generator? The police ... have received a phone call from the relatives of a sailor who said that during the dinner everything was falling on his head,."

He says some passengers were already wearing life jackets.

The crew member simply repeats that there has been a blackout. "We are checking the conditions on board," he says, promising to keep the coastguard informed.

Eleven people were killed in the accident and 24 are still unaccounted for, although some of the dead have yet to be identified.

The captain of the ship, Francesco Schettino, is under house arrest and has been accused of multiple manslaughter, causing a shipwreck and abandoning ship.

In another leaked recording released this week, the Italian coastguards are heard angrily pleading with Schettino and telling him to return to his listing ship.

The ship operators have blamed him for the disaster and praised the rest of the crew for their efforts to save lives. Passengers have complained that they were left for hours waiting in lifeboats, stairwells and assembly points before the order to evacuate was issued.

Murdoch to pay Jude Law, 36 others for hacking (AP)

LONDON ? Rupert Murdoch's media empire apologized and agreed to cash payouts Thursday to 37 people ? including a movie star, a soccer player, a top British politician and the son of a serial killer ? who were harassed and phone-hacked by his tabloid press.

The four ? Jude Law, Ashley Cole, John Prescott and Chris Shipman ? were among three dozen victims who received financial damages from Murdoch's British newspaper company for illegal eavesdropping and other intrusions, including email snooping.

Lawyers for the claimants said the settlements vindicated their accusation that senior Murdoch executives had long known about the scale of illegal phone hacking and had tried to cover it up.

Financial details of 15 of the payouts, totaling more than 640,000 pounds (about $1 million), were made public at a court hearing Thursday. The amounts generally ran into the tens of thousands of pounds ? although Law received 130,000 pounds (about $200,000), plus legal costs, to settle claims against the now-shuttered News of the World tabloid and its sister tabloid, The Sun.

Law was one of 60 people who have sued Murdoch's News Group Newspapers, claiming their mobile phone voicemails were hacked. Others whose settlements were announced Thursday at London's High Court included former government ministers Chris Bryant and Tessa Jowell, rugby player Gavin Henson, Princess Diana's former lover James Hewitt, singer Dannii Minogue and Sara Payne, the mother of a murdered girl.

It was the largest group of settlements announced yet in the long-running hacking scandal, which has shaken Murdoch's global empire, spurred the resignations of several of his top executives and reverberated through Britain's political, police and media elite.

Law, the star of "Sherlock Holmes" and "The Talented Mr. Ripley," said he was "truly appalled" at the scale of surveillance and privacy invasion that his case had exposed.

"No aspect of my private life was safe from intrusion by News Group Newspapers, including the lives of my children and the people who work for me," he said in a statement. "It was not just that my phone messages were listened to. News Group also paid people to watch me and my house for days at a time and to follow me and those close to me, both in this country and abroad."

News Group Newspapers admitted that 16 articles about Law published in the News of the World between 2003 and 2006 had been obtained by phone hacking, and that the actor had also been placed under "repeated and sustained physical surveillance." The company also admitted that articles in The Sun had misused Law's private information ? although it didn't go as far as to admit hacking by that paper.

Law said Murdoch's tabloids had been "prepared to do anything to sell their newspapers and to make money, irrespective of the impact it had on people's lives."

"I changed my phones, I had my house swept for bugs but still the information kept being published," Law said. "I started to become distrustful of people close to me."

The slew of settlements is one consequence of the revelations of phone-hacking and other illegal tactics at the News of the World, where journalists routinely intercepted voicemails of those in the public eye in a relentless search for scoops.

Murdoch closed the 168-year-old paper in July amid a wave of public revulsion over its hacking of the voicemails of missing 13-year-old Milly Dowler, who was later found murdered. More than a dozen ex-Murdoch employees have been arrested by police investigating phone hacking and bribery.

British politicians and police have also been ensnared in the scandal, which exposed the cozy relationship between senior officers, top lawmakers and Murdoch newspaper executives. A government-commissioned inquiry set up in the wake of the scandal is currently investigating the ethics of Britain's media and its links to police and politicians.

Law's ex-wife and actress Sadie Frost received 50,000 pounds (about $77,000) in damages for phone hacking and deceit by the News of the World. Bryant received 30,000 pounds (about $46,000), while Prescott ? a prominent member of the Labour Party who was Britain's former deputy prime minister ? accepted 40,000 pounds (about $62,000).

After each statement, News Group lawyer Michael Silverleaf stood to express the news company's "sincere apologies" for the damage and distress its illegal activity had caused.

Many of the statements ended with victims saying they felt vindicated after years in which Murdoch's company denied phone hacking had been widespread at the News of the World. The company had initially vowed to fight the claims in court.

"Today's court decision at long last brings clarity, apology and compensation for the years of hacking into my telephone messages by Rupert Murdoch's News Group Newspapers," Prescott told his local newspaper, the Hull Daily Mail. "It follows years of aggressive denials and a cavalier approach to private information and the law."

In a statement, the claimants' lawyers said that "News Group has agreed to compensation being assessed on the basis that senior employees and directors ... knew about the wrongdoing and sought to conceal it by deliberately deceiving investigators and destroying evidence."

News Group did not admit this in court, and declined to comment on the statement.

The claimants described feeling mistrust, fear and paranoia as phone messages went missing, journalists knew their movements in advance or private information appeared in the media.

Frost said the paper's activity had caused her and Law to suspect one another. Henson said he accused the family of his then-wife, singer Charlotte Church, of leaking stories to the press.

Other claimants included Guy Pelly, a friend of Prince William who was awarded 40,000 pounds (about $62,000), and Tom Rowland, a journalist who wrote for one of Murdoch's own newspapers, the Sunday Times. He received 25,000 pounds ($39,000) after News Group admitted hacking his phone.

In a handful of cases the company admitted hacking into emails, as well as telephone voice mails. Christopher Shipman, whose father, Dr. Harold Shipman, was a notorious serial killer thought to have murdered more than 200 of his patients, had emails containing sensitive legal and medical information intercepted by the News of the Word. He was awarded "substantial" undisclosed damages.

The settlements announced Thursday amount to more than half of the phone-hacking lawsuits facing Murdoch's company, but the number of victims is estimated to be in the hundreds.

Mark Lewis, a lawyer for many victims, said in an email that the fight against Murdoch's media empire wasn't over.

"Fewer than 1 percent of the people who were hacked have settled their cases," he said. "There are many more cases in the pipeline. ... This is too early to celebrate, we're not even at the end of the beginning."

Many victims had earlier settled with the company, including actress Sienna Miller ? whose on-again, off-again romance with Law generated widespread press interest ? and the parents of murdered teenager Dowler, who were awarded 2 million pounds (about $3.1 million) in compensation.

Ten further cases are due to go to court next month, though lawyers said more settlements are likely.

This weekend, hundreds of millions of Chinese will return to hometowns to celebrate the Chinese New Year of the Dragon. But the annual pilgrimage is marked by the annual struggle at the train station.

Every year at the Chinese New Year the Ministry of Railways has the same problem: carrying the hundreds of millions of people who want to go home to celebrate the new year, China?s biggest holiday with their families. And every year it is a nightmare.

Passengers have long complained about endless lines at ticket offices or about paying high prices to scalpers who corner the market; and that?s before they even get on the train to brave agonizingly long and cramped journeys. Being with family at new year is like Thanksgiving and Christmas wrapped into one for Chinese.?

So this year, as China prepares to usher in the Year of the Dragon on Sunday, the Ministry offered holidaymakers the chance to buy their tickets online.

That would have been a good idea, except that its server collapsed under the strain.

On Jan. 9, the ticket booking website took 1.4 billion hits, the Ministry said.

The ensuing crash left a lot of disgruntled customers.?

?I tried on the Internet for a whole day but I never managed to log on,? says Fan Zhixin, who works in a website?s finance department, as she lined up for a ticket outside Beijing?s central station on Thursday.

Eventually, she recounted, she had reached the sales office on the phone, ?but by the time I got through all the seats had been sold, so I had to buy a standing only ticket.?

Since her journey to Ulanhot, in Inner Mongolia, was going to take 20 hours and the idea of standing in a crowded corridor for that long was too appalling, Ms. Fan was making one last bid for a seat.

As she dreaded, there were none. ?This will be very terrible,? she says, wheeling her imitation Louis Vuitton suitcase through the crowd toward the platform.

Ma Anjia, a migrant construction worker heading for his hometown in Shanxi, 16 hours West of Beijing, had secured a seat, but no thanks to the new Internet booking system. In fact, that had made it harder for him.

?I don?t know how to use the Internet,? Mr. Ma laughs. ?I queued up.?

But because tickets became available online two days before they were sold at railroad ticket offices, he kept finding the agencies had sold out. ?I went to five or six different places and waited hours at each one before I managed to buy the tickets I needed,? Ma says.

Still, at least he should be home before the weekend.

Travelers leaving things until the last minute have something else to worry about: Weather forecasters are warning that a wave of snow and rain over the coming days could make travel even more tricky.?

Drug lobby wants clearer FDA rules for diet pills (Reuters)

WASHINGTON (Reuters) ? The pharmaceutical industry may stop investing in medicines to treat diseases like diabetes or obesity without more explicit guidelines from U.S. regulators, the chairman of the drug trade group said on Thursday.

The Food and Drug Administration must approve any medical products sold in the United States, but drug companies say they cannot always predict how the agency weighs risks and benefits for medicines that could be widely used.

To avoid the uncertainty, companies may focus on specialized cancer drugs, where it is clear patients and the FDA are willing to accept serious side-effects in exchange for potentially life-saving treatments.

"You're starting to see primary care diseases becoming somewhat neglected," said Christopher Viehbacher, chairman of the board of the Pharmaceutical Research and Manufacturers of America (PhRMA), in an interview.

"To make sure we're not ignoring unmet needs in primary care, we need a lot more clarity around the risk-benefit so there's predictability when we invest in these products," said Viehbacher, also chief executive of French drugmaker Sanofi SA.

PhRMA and other groups are gearing up their lobbying strategy ahead of Congressional hearings on FDA user fees, or the funds companies pay to the agency in exchange for faster review times.

Since fees from makers of drugs and medical devices provide more than a third of the agency's funding, the bill often serves as a vehicle for broader FDA-related changes.

Congress must renew the Prescription Drug User Fee Act (PDUFA) every five years, with the current legislation expiring in September 2012.

Over the past year, the FDA has drawn fire from some manufacturers for being too cautious in reviewing medical products, hindering U.S. innovation.

They point to obesity drugs, where Arena Pharmaceuticals, Orexigen Therapeutics and Vivus have hit roadblocks in gaining approval for their diet pills because of potential safety concerns.

About a third of U.S. adults are obese and medicines could help manage the weight along with diet and exercise.

Viehbacher said the FDA is aware of the challenge of balancing patient safety and innovation.

"You're hearing the FDA say that yes, we need to protect patients, and yes, we need to keep medicines accessible," he said. "I don't think anybody has to sacrifice. I think there just has to be a lot more science."

Bail quadrupled for Philadelphia hockey fan brawler (Reuters)

PHILADELPHIA (Reuters) ? A judge on Wednesday quadrupled the bail for a Philadelphia Flyers fan accused of severely beating an off-duty police officer who was wearing a rival New York Rangers jacket after a hockey game.

Common Pleas Court Judge Paula Patrick boosted the bail for Dennis Veteri, 32, a bricklayer from Glassboro, New Jersey, to $400,000 from the original $100,000.

Veteri, who was wearing Philadelphia Flyers gear on the night of the January 2 assault, was taken from the courtroom by guards.

The victim, Neal Auricchio, 30, was attacked outside the famous cheese steak restaurant Geno's Steaks following a professional hockey game between the two fierce rivals.

Auricchio, an off-duty police officer and Iraq war veteran from Woodbridge, New Jersey, was knocked unconscious and was to undergo facial reconstruction surgery for his injuries, police said.

After Veteri's bail was increased, it was unclear whether he could raise enough to remain free.

"We'll get it if we have to sell ourselves," said a woman outside the courtroom who identified herself as a relative. She was among eight family members who showed up in court to support Veteri.

Assistant district attorney Caroline Keating-McGlynn, who had asked for $500,000 bail, said the judge "did the right thing" by raising the amount.

She argued that Veteri has a long history of drug and assault charges, including four assault convictions.

But defense attorney Michael DeFino maintained that Veteri, a father of three, has no history of failure to appear in court.

"He is not a flight risk," DeFino said. He said Veteri is "basically a good person who has struggled with addictions in his life."

In raising the bail, the judge said Veteri's record indicates violent behavior and a possible risk to society.

"That is a concern to this court," the judge said.

Philadelphia police were still seeking three other suspects in the beating. They have relied on what Keating-McGlynn said was a video of the beating taken by a passerby.

China cancer village tests law against pollution (Reuters)

XIAOXIN, China (Reuters) ? Nothing in Wu Wenyong's rural childhood hinted he would end up on a hospital bed aged 15, battling two kinds of cancer.

Born to poor farmers in Xiaoxin, a dusty village of low brick houses in southwestern Yunnan province, he paddled in the Nanpan River as a child and later helped his parents tend rice.

About 3 km (two miles) from Wu's home stands a three-storey high hill of chromium slag produced from the Yunnan Luliang Peace Technology Company. The runoff from chromium-6, listed as a carcinogen by the World Health Organisation, seeped into the Nanpan, turning its waters yellow.

And the toxic water and earth that Wu's family blames for his condition have become a battleground over how far China will bend to letting courts punish pollution.

The chromium hill is a rallying point for a coalition of environmental advocacy groups, who have filed a public interest lawsuit for residents of Xiaoxin and nearby Xinglong in a special environment court.

Last September, Wu's face ballooned and tumor-like growths developed on his neck. He was diagnosed with thymoma, cancer of the thymus gland in the chest, and with leukemia.

"The pollution is quite terrible. I've heard stories of cattle dying," Wu said, from his hospital bed in Kunming, the capital of Yunnan. "I've seen the water in the river and it's all yellow. I've never drunk the water."

Beset by growing public alarm and protests about pollution, China's leaders have reached for a remedy they have otherwise shown little appetite for: letting the courts decide. Those courts come under the control of the ruling Communist Party, but environmental campaigners spot a welcome, if narrow opening.

In a country where non-governmental organizations have long been treated with suspicion by authorities, collective litigation by organizations with no government backing is breaking new ground in the environment courts. The groups want the privately owned company to establish a 10 million yuan ($1.6 million) compensation fund for an environmental clean-up.

"This is a significant case," said Qin Tianbao, a professor of environmental law at Wuhan University, uninvolved in the case. "In the past, lawsuits were only launched by agencies with semi-official backing. If it is possible that an organization with absolutely no government backing can bring about a public interest litigation, then it certainly is a good thing."

The Yunnan Luliang Peace Technology Co. was established in 2003, according to its website. It makes chromium, a metal used in stainless steel, paints, plastic and dyes, and sodium dichromate, used for the tanning of leather.

Both are highly carcinogenic metals.

The company declined Reuters' request for an interview.

Polluting factories have been relocated from urban areas to the countryside, home to half of China's population. Local officials rely on these industries to generate tax revenues.

"Why was the factory built here and not Beijing and Shanghai? Because in Beijing and Shanghai, there are people watching," said Chang Shichen, 47, a villager from Xinglong.

The lawsuit had been due to go to trial in the city of Qujing last November, but was delayed until February to give advocates more time to assess the ecological damage, said Li Bo, director of Friends of Nature, one of the groups involved.

Environmental groups dispute local authorities' assertion that the water is now safe.

"There is no problem with the village's water now, although I'm not sure about the specific circumstances," Ji Honghua, an official with the Qujing Municipal Environmental Protection Bureau, said by telephone.

In the two villages, which are surrounded by an industrial park, residents drink either bottled water or water supplied from a small river and later filtered.

The local government gave Wenyong's father, Wu Shuliang, 1,000 yuan after he told officials about his son's plight. He borrowed 50,000 yuan for his son's chemotherapy -- and family members say there is no health insurance to reclaim the money.

"All I want is for the government to give us an answer about the pollution," said Wenyong, a tear rolling down his cheek.

His hair has fallen out from chemotherapy and he weighs 32 kg (70 pounds), almost 10 kg lighter than before his illness.

Wenyong's doctor, a woman surnamed Li, said her patient in any case needs two to three years of follow-up treatment.

Last year, the environmentalist Li learned from a media report that 5,000 tonnes of chromium-6 had been dumped outside a district of Qujing. He investigated and found 140,000 tonnes had been buried in the nearby villages of Xiaoxin and Xinglong.

"Many villagers didn't know what chromium is, they thought it was soil, so they'll dig up the chromium to pave roads. "Others will use it to build the foundation of their homes," he said. "They work barefooted in the fields. Some of their feet would start to rot and they would never understand why."

HIGH EXPOSURE

The chromium-6 levels in the water were 200 times above the permissible limits, Ma Tianjie of Greenpeace in China said after

an independent investigation was conducted.

Enforcement of laws regulating the disposal of chromium is poor. Greenpeace's Ma estimates there are 1 million tonnes of chromium-6 dumped across China that still has not been disposed of, based on environment ministry data.

Virtually every resident of the villages knew of someone who contracted cancer after the industrial park was set up about seven years ago. No epidemiological studies have been conducted.

Studies have shown that exposure to chromium-6 causes leukemia and cancer of the stomach, liver and breast.

"It is one of the worst chemicals to get in drinking water,"

Max Costa, chairman of the department of environmental medicine at New York University, said in emailed comments.

Wu's family needs no convincing about what is to blame.

"Our plot of farmland was just next to the chromium slag," said the elder Wu. "They even dug a drain next to our land for the runoff."

In September, the local government arrested five people for the dumping and ordered the company to halt production of chromium and sodium dichromate.

The hill is now covered by metal slabs. Guards monitor the company around the clock to ensure production has stopped and detoxification will be completed in August, Ji from the Qujing environmental bureau said.

Li recruited lawyers, academics and other NGOs to look into the feasibility of filing a lawsuit and the team named the Qujing Environmental Protection bureau as a co-plaintiff,

Two weeks after their case was accepted by the Qujing court, the central government's Civil Law Draft Amendment Office sought Li's views on amendments to draft legislation.

An official told him the government was considering letting "social organizations" bring lawsuits about pollution and food safety.

Although "social organizations" have not been defined, new laws could lead to more "public interest" litigation and allow ordinary people to join forces to defend their interests.

Li said he was "cautiously optimistic" about prospects for victory in the Qujing case -- which he said he had raised in his discussions with the government.

"If this has already happened, that an environmental organization with a status like ours could successfully file a public interest lawsuit, not including us in future interpretations of the amendments to the civil law, will be something that is unjustified," he told the official.

But without an independent judiciary, the environment courts will continue to avoid handling sensitive cases, said Zhang Jingjing, a lawyer involved in many pollution causes.

"Our circle of lawyers has a saying: in China, the big cases are about politics, the mid-sized cases are about influence and only the small cases deal with law," Zhang said.
